Labour Court interdicts NUMSA Congress

The Labour Court has interdicted the national NUMSA congress from proceeding.

Ruth Ntlokose, a NUMSA member and the elected second Deputy Oresident if NUMSA, launched the urgent application which led to the judgment.

The matter was opposed by Irvin Jim (NUMSA’s General Secretary) and by NUMSA. It was argued on 22 July 2022, and judgment was delivered by Judge Graham Moshoana on 23 July 2022.

Ms Ntlokose had been suspended by NUMSA pending a disciplinary hearing.

She argued that her suspension (and that if others) was in breach of NUMSA’s constitution, and that the holding of the congress would be in breach of NUMSA’s constitution.

The court accepted that the application was urgent and upheld Ms Ntlokose’s arguments.

It declared the suspensions of Ruth Ntlokose and the other NUMSA members unconstitutional, invalid and unenforceable in law, and interdicted NUMSA from proceeding with the 11th National Congress scheduled to take place on 25-29 July 2022, until it fully complies with the terms of its own constitution.
